01 Acceptance of terms

By accessing or using Terrain360.com (the "Website"), along with any associated APIs, demo materials, JSON manifests, code examples, or panoramic imagery and data (collectively, the "Services"), you agree to be bound by these Terms. If you accept on behalf of a company or other entity, you represent that you have the authority to bind it.

02 Permitted use

We grant you a limited, non-exclusive, non-transferable, revocable license to view the Services through a standard web browser or approved viewer — for personal evaluation, demonstration, or licensed commercial use only.

03 Prohibited activities

You agree not to, and not to help or permit anyone else to:

• Download, scrape, crawl, spider, or systematically retrieve any panoramic images, tiles, zoom levels, metadata, JSON manifests, or other data from the Services using automated tools — including curl, wget, scripts, bots, scrapers, or download managers.
• Access or attempt to access any non-public, high-resolution, deep-zoom, or raw imagery without an explicit written license agreement.
• Reconstruct trails, scenes, or datasets by bulk-downloading tiles or cube faces.
• Remove, obscure, or alter any watermarks, copyright notices, or proprietary markings.
• Reverse-engineer, decompile, or extract source code or tile URLs for unauthorized use.
• Use the Services in any way that exceeds reasonable individual human viewing or approved demonstration.

Violating these prohibitions is a material breach of these Terms and may result in immediate termination of access, revocation of any demo credentials, and pursuit of all available legal remedies — including claims for copyright infringement, breach of contract, and misappropriation of trade secrets.

04 Intellectual property & data ownership

All panoramic imagery, 360° photography, tiled cube maps, zoom levels, metadata, AI descriptions, GPS coordinates, scene manifests, and derived datasets are the exclusive property of Terrain360 or its licensors, and are confidential, proprietary assets. No ownership or unrestricted rights transfer to you under any circumstances without a separate written license agreement.

05 Demonstration & pitch access

Any access granted for evaluation, pitch, or demonstration — including curl examples, JSON scene data, signed URLs, API keys, or special demo links — is strictly limited to live, human viewing during the evaluation period. Bulk downloading, storage, redistribution, or retention of high-resolution data beyond the demo session is prohibited and will be treated as theft of intellectual property.

06 Monitoring & enforcement

We actively monitor access patterns. Unusual activity — high request rates, sequential tile downloads, or attempts to access large numbers of scenes — triggers automatic blocking and review. We reserve the right to revoke access instantly and without notice.

07 Limitation of liability

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY UNAUTHORIZED DOWNLOADING OR SCRAPING EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR (B) THE REASONABLE LICENSING VALUE OF THE DATA IMPROPERLY ACCESSED.

08 Governing law & venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Richmond, Virginia.
