01 Acceptance of terms

These Terms are between you and Terrain360 LLC, Richmond, Virginia (“Terrain360”, “we”). By accessing or using Terrain360.com (the "Website"), along with any associated APIs, the Terrain360 app for ChatGPT and connector for Claude, demo materials, JSON manifests, code examples, or panoramic imagery and data (collectively, the "Services"), you agree to be bound by these Terms. If you accept on behalf of a company or other entity, you represent that you have the authority to bind it.

02 Permitted use

We grant you a limited, non-exclusive, non-transferable, revocable license to view the Services through a standard web browser or approved viewer — for personal evaluation, demonstration, or licensed commercial use only. Separately, the brand assets and press materials published at terrain360.com/media-kit carry their own standing licence, set out in section 05 below.

03 Recorded imagery, not current conditions

Every scene shows when it was captured. Rivers, trails and facilities change, and the Services do not report current water levels, weather, closures, access or safety. Check current conditions with the managing agency before you go. Outdoor recreation carries risk, and you are responsible for your own decisions.

04 Terrain360 in ChatGPT and Claude

The Terrain360 app for ChatGPT and connector for Claude are approved viewers: read-only views of the same published catalog, covered by these Terms. Your use of ChatGPT or Claude is also governed by OpenAI's or Anthropic's terms. How the app handles data is set out in our Privacy Policy.

05 Brand assets & press use

We publish a media kit at terrain360.com/media-kit so that journalists, partners, event organisers and grant applicants can use our materials without asking first. For the specific items published there — our logos and brand marks, the images expressly labelled as approved press images, and the supplied embed code for a live 360° scene — we grant a worldwide, royalty-free, non-exclusive licence to reproduce, display and distribute them in editorial, promotional, partner and funding materials, subject to the following:

• Imagery carries the credit Imagery © Terrain360 wherever it appears.
• Logos are used as supplied — not recoloured, stretched, rotated, outlined, or rebuilt.
• The embed is used as issued, without stripping attribution, framing it as your own product, or placing it in a context that implies Terrain360 endorses you.
• Nothing here transfers ownership, and we may withdraw the licence for a specific use that is misleading, defamatory, or misrepresents our work.

This licence is limited to the items actually published in the media kit. It does not extend to the wider corpus — panoramic scenes, tiles, deep-zoom or raw imagery, metadata, manifests or derived datasets — which remain governed by sections 06 and 07. Downloading a press image from the media kit is permitted; harvesting imagery from the viewer is not.

06 Prohibited activities

Except as expressly permitted by section 05 (Brand assets & press use), you agree not to, and not to help or permit anyone else to:

• Download, scrape, crawl, spider, or systematically retrieve any panoramic images, tiles, zoom levels, metadata, JSON manifests, or other data from the Services using automated tools — including curl, wget, scripts, bots, scrapers, or download managers.
• Access or attempt to access any non-public, high-resolution, deep-zoom, or raw imagery without an explicit written license agreement.
• Reconstruct trails, scenes, or datasets by bulk-downloading tiles or cube faces.
• Remove, obscure, or alter any watermarks, copyright notices, or proprietary markings.
• Reverse-engineer, decompile, or extract source code or tile URLs for unauthorized use.
• Use the Services in any way that exceeds reasonable individual human viewing or approved demonstration.

Violating these prohibitions is a material breach of these Terms and may result in immediate termination of access, revocation of any demo credentials, and pursuit of all available legal remedies — including claims for copyright infringement, breach of contract, and misappropriation of trade secrets.

07 Intellectual property & data ownership

All panoramic imagery, 360° photography, tiled cube maps, zoom levels, metadata, generated descriptions, GPS coordinates, scene manifests, and derived datasets are the exclusive property of Terrain360 or its licensors, and are confidential, proprietary assets. No ownership or unrestricted rights transfer to you under any circumstances without a separate written license agreement, save for the limited licence granted in section 05.

08 Demonstration & pitch access

Any access granted for evaluation, pitch, or demonstration — including curl examples, JSON scene data, signed URLs, API keys, or special demo links — is strictly limited to live, human viewing during the evaluation period. Bulk downloading, storage, redistribution, or retention of high-resolution data beyond the demo session is prohibited and will be treated as theft of intellectual property.

09 Monitoring & enforcement

We actively monitor access patterns. Unusual activity — high request rates, sequential tile downloads, or attempts to access large numbers of scenes — triggers automatic blocking and review. We reserve the right to revoke access instantly and without notice.

10 Limitation of liability

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY UNAUTHORIZED DOWNLOADING OR SCRAPING EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR (B) THE REASONABLE LICENSING VALUE OF THE DATA IMPROPERLY ACCESSED.

11 Governing law & venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Richmond, Virginia.
