1. Definitions
- Site means terrain360.com, its subdomains, its APIs and the content delivery domains that serve its imagery.
- Text Content means trail descriptions, hotspot narratives, place names and metadata, and the structured corpus served under
/api/llm/.
- Licensed Data means panoramic imagery, image tiles, per-scene spatial records, scene analysis records, sequence indexes and any Sentinel detection records that Terrain360 delivers to you under an order.
- Delivered Set means the specific files and records identified in the manifest for an order.
- Order means a quote, invoice or agreement that identifies a Delivered Set and its fee.
- You means the person or organisation using the Site or receiving a Delivered Set, including any automated agent acting for you.
2. Free text with attribution
You may copy, index, summarise, use for retrieval and grounding, and use for training and evaluating models any Text Content, without charge, on these conditions:
- Attribute the material to Terrain360 (terrain360.com) in any product, publication or dataset that reproduces it substantially.
- Where you cite a specific place, link to its page on the Site so a reader can see it.
- Respect the crawl rules in
robots.txt and the rate limits the Site enforces.
- Do not present Text Content as your own original work.
Species observations under /api/observations are third-party records republished under their own licenses; they are not Text Content and are not licensed by Terrain360.
3. Licensed data: grant
On payment of the fee in an Order, Terrain360 grants you a non-exclusive, non-transferable, worldwide, perpetual license to use the Delivered Set for the following purposes:
- Training, fine-tuning, evaluating and benchmarking machine learning models of any kind, including generative, vision, geospatial and world models.
- Internal research, analysis, simulation, mapping and product development.
- Distributing and commercialising models, weights, embeddings, derived measurements and products built from the Delivered Set. Model weights are yours.
- Publishing research results, and reproducing individual scenes as illustrations in papers, documentation and presentations with attribution.
Affiliates under your control may use the Delivered Set under this license. Contractors may use it solely on your behalf and subject to these terms.
Imagery and scene records that you retrieve from the Site without an Order, including through the sample pack, are licensed only for evaluation of the corpus for up to 90 days and for the free uses in section 2.
4. Restrictions
You must not, and must not allow others to:
- Redistribute, sell, sublicense, publish or publicly re-host the panoramas, tiles or records in the Delivered Set, in whole or substantial part, other than as illustrations under section 3.
- Build or operate a street-level imagery viewer, a public imagery archive, or a competing imagery licensing service from the Delivered Set.
- Use the imagery to identify, track or profile individuals, or to identify vehicles or private property.
- Remove, obscure or alter the license record, manifest, checksums or attribution that ship with the Delivered Set.
- Retrieve imagery or records from the Site by bulk automated means beyond the free uses in section 2 and the endpoints documented for that purpose, or circumvent access controls or rate limits.
- Use the Delivered Set in violation of applicable law, including export control and sanctions law.
5. Ownership and rights
Terrain360 and its licensors retain all right, title and interest in the Site content and the Licensed Data. No rights are granted other than those stated here. Some corridors on the Site were captured under agreements with clients or public agencies that reserve rights to them; those corridors are excluded from Delivered Sets and are identified in the quote. Terrain360 licenses only scenes it is entitled to license.
Terrain360 may reference you as a licensee in customer lists unless you ask otherwise in writing.
6. Ordering, payment and delivery
- Fees are those on the licensing page at the time of the Order, or as stated in a quote. Fees are in US dollars and exclude taxes, which you are responsible for.
- Invoices are due on receipt unless the Order states otherwise. Public agencies may pay by purchase order on their standard terms.
- Terrain360 delivers a signed manifest for the Delivered Set within five business days of payment, with a 30 day download window that is re-issued on request. Files are accompanied by checksums.
- A Delivered Set is accepted when downloaded, or 30 days after delivery, whichever is first. Files that fail their checksum are replaced without charge.
- Fees are non-refundable once a Delivered Set has been downloaded.
7. Privacy
The imagery depicts public outdoor places and may incidentally include people, vehicles and property. Terrain360 does not collect or supply the identity of anyone depicted. You agree not to attempt to identify them and to remove or blur any scene that a depicted person asks Terrain360 to withdraw, on notice from Terrain360. You are responsible for your own compliance with data protection law in the jurisdictions where you use the Delivered Set.
8. Term and termination
The license for a Delivered Set is perpetual, subject to this section. Terrain360 may terminate the license on written notice if you materially breach sections 4 or 7 and do not cure the breach within 30 days of notice. On termination you must stop using the Delivered Set and destroy your copies, but models, weights and derived measurements already created may continue to be used. Sections 4, 5, 7, 9 and 10 survive termination.
9. Warranties and liability
Terrain360 warrants that it has the right to grant the license in section 3 for the Delivered Set. Otherwise the Site content and Licensed Data are provided as is, without warranty of any kind, express or implied, including accuracy of position, heading, elevation, timestamps or scene analysis, fitness for a particular purpose, and non-infringement of third-party rights in depicted objects.
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, and Terrain360's total liability under an Order is limited to the fees paid for that Order. This limit does not apply to a party's breach of sections 4 or 7, or to liability that cannot be limited by law.
10. General
- These terms and the applicable Order are the entire agreement for a Delivered Set. Where an Order or a signed agreement conflicts with these terms, the Order or agreement prevails.
- These terms are governed by the laws of the Commonwealth of Virginia, USA, and the parties submit to the courts located in Richmond, Virginia, except that either party may seek injunctive relief in any competent court.
- You may not assign the license except to a successor to your whole business that agrees in writing to these terms.
- Terrain360 may update these terms for future Orders by publishing a new version at this address; the version in effect when an Order is placed governs that Order.
